These Terms form an agreement between you and the operator of Map_MarkUp (we, us or our). By creating an account or using the service, you agree to these Terms and acknowledge the Privacy Policy.

Eligibility and accounts

You must be legally capable of entering this agreement. If you use Map_MarkUp for an organisation, you confirm that you are authorised to do so. You must provide an appropriate username, protect your password and promptly tell us about suspected unauthorised access. You are responsible for activity through your account except to the extent caused by us.

Projects and permissions

Project links, QR codes and keys can provide access to shared work. You must only share them with intended participants. Project administrators can manage members and roles, change access credentials, clear project data and delete projects. Team leaders and other authorised users may manage team features. Your use of a project may also be subject to rules set by the organisation or administrator responsible for it.

Your content

You retain any rights you have in notes, messages and other content you submit. You give us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display that content only as reasonably needed to operate, secure and improve the service. You confirm that you have the right to submit the content and make it available to the intended project users.

Acceptable use

You must not use the service to break the law; infringe another person's rights or privacy; harass, threaten or mislead people; upload malicious code; probe or bypass security or access controls; disrupt the service; scrape or overload it; impersonate another person; or share location or personal information without appropriate authority. Do not place confidential or sensitive information in notes or chat unless your organisation permits it and the project audience is appropriate.

Location and safety

Location functions depend on device, browser and network estimates and may be delayed or inaccurate. Map_MarkUp is a coordination tool, not an emergency, navigation, personal-safety or worker-safety service. Do not rely on it where an inaccurate or unavailable location could cause harm. You are responsible for obtaining any notices, permissions or consents required before using the service to monitor workers or other people.

Availability and changes

We aim to provide a useful and reliable service, but it may be interrupted, delayed, changed or unavailable. Keep independent copies of important information. We may modify or discontinue features and may update these Terms. If a material change affects existing users, we will take reasonable steps to give notice. Continued use after updated Terms take effect constitutes acceptance where permitted by law.

Suspension and termination

You may stop using the service and request account deletion. We may restrict or suspend access where reasonably necessary to protect users or the service, investigate suspected misuse, comply with law, or respond to a material breach. Where practical, we will give notice and a reasonable opportunity to address the issue.

Liability and consumer rights

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law. To the extent permitted by law, we are not responsible for indirect or consequential loss arising from your use of the service, project administration decisions, content submitted by users, or events outside our reasonable control. Any permitted limitation applies only to the extent it is fair and lawful in the circumstances.

These Terms are governed by the laws applicable in Queensland, Australia, and disputes may be brought in courts with jurisdiction there, without limiting any rights you have to bring a claim elsewhere under mandatory law.
